CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION / RETURN CONDITIONS

1) General Provisions

By placing an electronic order through this website, you are deemed to have accepted the Preliminary Information Form and the Distance Sales Contract presented to you. Buyers are subject to the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable legislation. Unless otherwise stated, shipping costs shall be borne by the Buyer. Each purchased product is delivered to the person/organization at the address indicated by the Buyer during the order, provided that it does not exceed the legal maximum period of 30 days. If the product is not delivered within this period, the Buyer may terminate the contract. The product must be delivered complete, in accordance with the specifications specified in the order, and with documents such as a warranty certificate and user manual, if any. In the event that the fulfillment of the purchased product becomes impossible, the Seller shall inform the Buyer in writing within 3 days of learning of this situation and return the total price to the Buyer within 14 days at the latest.

2) Non-Payment

If the Buyer does not pay the product price or the transaction is canceled in the bank records, the Seller's obligation to deliver the product terminates.

3) Unauthorized Credit Card Use

After the product is delivered, if the price paid by the Buyer is not paid to the Seller by the relevant bank/financial institution due to the unfair use of the credit card by unauthorized persons, the Buyer is obliged to return the product to the Seller within 3 days, with the shipping costs belonging to the Seller.

4) Unforeseen (Force Majeure) Reasons

If force majeure events occur that the Seller cannot foresee and the delivery cannot be made on time, the Buyer shall be notified. The Buyer may cancel the order, request a replacement with an equivalent product, or postpone the delivery until the obstacle is removed. In case of cancellation: if the payment was made in cash, it will be refunded to the Buyer in cash within 14 days. For credit card payments, the refund is made to the bank within 14 days; the time for the bank to reflect this on the Buyer's account may vary depending on the bank's internal processes.

5) Buyer’s Obligation to Inspect

The Buyer must check the product before delivery; damaged products (crushed, broken, torn packaging, etc.) should not be received from the courier. Received products are deemed undamaged. If the right of withdrawal is to be exercised, the product must not be used, and protective tapes/labels/packaging must not be removed. The invoice must be sent back with the product for returns.

6) Right of Withdrawal (14 Days)

The Buyer may exercise the right to withdraw from the contract within 14 (fourteen) days from the delivery of the product to themselves or to the person/organization indicated, without giving any justification, by notifying the Seller through the communication channels below.

Withdrawal Period and Costs For services other than products, the 14-day period starts from the date the contract is established. The right of withdrawal cannot be used in service contracts where the performance has started with the consumer's approval before the expiry of the period. Shipping costs arising from the use of the right of withdrawal belong to the Seller. To exercise the right of withdrawal, a written notification must be made via registered mail, email, or fax (if available) within 14 days, and the product must be outside the scope of "Products for which the Right of Withdrawal Cannot Be Exercised" and must be unused/untested.

7) Exercise of the Right of Withdrawal – Required Documents

  • The original invoice (a "Return Invoice" is mandatory for corporate purchases),

  • Return form (if available),

  • The product must be sent complete and undamaged with its original box/packaging, all accessories, and standard gifts.

8) Return Process and Conditions

The Seller is obliged to return the total price and the documents that put the Buyer under debt within 10 days at the latest from the receipt of the withdrawal notification and to receive the goods back within 20 days. If there is a decrease in value or impossibility of return due to the Buyer's fault, the Buyer shall compensate the Seller's damages in proportion to their fault. However, the Buyer is not responsible for changes and deteriorations caused by the proper inspection of the product within the withdrawal period. If the order total falls below the campaign limit due to withdrawal, the discount amount utilized is canceled, and the refund amount is updated accordingly.

9) Return Exceptions for Hygiene and Underwear Products

Important: According to the legislation, withdrawal/returns for the following products are not accepted or are subject to specific conditions due to health and hygiene reasons:

  • Underwear bottom parts (panties, boxers, strings, etc.), swimwear/bikini bottoms, and similar hygienic products cannot be returned if the package/packaging is opened or if they have been tried on/used.

  • Cosmetics and personal care products cannot be returned if the protective tape/packaging is opened.

  • Opened audio/video recordings, books, digital content, software, data storage devices, and computer consumables (toner, cartridge, etc.) cannot be returned.

  • Perishable goods or products that are mixed with other products after delivery and cannot be separated cannot be returned.

  • Services where performance has started with the consumer's approval within the withdrawal period.

Special Note from Dominant Shop: Returns of products in the underwear category whose package/label/protective tape has been opened, tried on, or hygiene tape has been removed are strictly not accepted. If you are hesitant about size or product selection, please contact our support line.

10) State of Default and Legal Consequences

If the Buyer falls into default on credit card payments, they agree to pay interest and be responsible to the bank under the agreement between them and the bank. The bank may seek legal remedies and demand costs/attorney's fees from the Buyer. The Buyer also agrees to compensate for damages suffered by the Seller due to delayed performance.
